Chad Kessinger & Patrick Muldoon Obtain Defense Verdict for Contractor

In June 2023, Chad Kessinger and Patrick Muldoon successfully defended a road contractor at trial in Perry Circuit Court against allegations of real property damage secondary to blasting and construction activities conducted by Bizzack Construction, LLC on a road improvement project in Hazard, Ky. A local real estate developer claimed damages to four commercial buildings and one residential structure, and sought compensatory and punitive damages totaling over $9.7 million. Two sets of local residents also claimed damages to their respective residences, and sought compensatory and punitive damages totaling more than $1.6 million. Following a 7-day trial, the jury returned a complete defense verdict in favor of Bizzack by determining that the company’s blasting and construction activities were not a substantial factor in causing or contributing to the damages alleged to each structure.
