Blake Edwards & Daniel Wenig Obtain Summary Judgment for Auto Dealer

In May 2023, Blake Edwards and Daniel Wenig obtained Summary Judgment in Fayette Circuit Court on behalf of an auto dealership that was sued for subrogation and indemnification by an underinsured motorist carrier.  The lawsuit arose out of a motor vehicle versus pedestrian accident.  Mr. Edwards and Mr. Wenig argued that the auto dealership could not be sued for subrogation or indemnification since it was not an underinsured motorist as defined by Kentucky law, and that the individual operating the auto dealership’s courtesy vehicle had previously agreed to assume all liability that arose out of her use of the courtesy vehicle.  The Court was convinced by these arguments and as a result, it promptly granted Summary Judgment on all grounds in favor of the auto dealership and dismissed all of the claims asserted against the auto dealership.
