Mike Maloney & Blake Edwards Successfully Defend Merchant – 2018

In June 2018, Mike Maloney and Blake Edwards obtained Summary Judgment in Jefferson Circuit Court on behalf of a merchant that was sued for negligently delivering a pallet of goods, which the Plaintiff alleged had caused her to trip and fall.  The Court held that the merchant owed no duty to Plaintiff because the merchant was not in possession or control of the premises at the time of the alleged fall.  The Court also held that the merchant was not liable for the actions of an independent contractor that delivered the pallet of goods.  As a result, the Court dismissed all claims against the merchant.
