Mike Maloney and Blake Edwards Successfully Defend UIM Insurer – 2017

In February 2017, Mike Maloney and Blake Edwards obtained Summary Judgment in Jefferson Circuit Court on behalf of an insurance company that was sued for underinsured motorist benefits.  The Plaintiff was a passenger in a single motor vehicle accident that occurred in Louisville, Kentucky.  At the time of the accident, the Plaintiff resided with her adult son.  The Plaintiff filed an underinsured motorist claim against her son’s insurance policy.  The Court found that the vehicle the Plaintiff was occupying at the time of the accident did not qualify as an underinsured motor vehicle because it was owned by a family member of the son.
